Michael's Monthly Message for August 2009

Dear Family, Friends, and Supporters:

Welcome to my Monthly Message for August 2009!

Well, it seems I have been blessed with good news for this month. The En Banc Petition filed by the Attorney General’s Office has been denied. This is good news for getting me one step closer to my freedom. Although, I must admit, I was very disappointed to learn one Judge (Sandra Lynch) wrote a deplorable 20 page dissent. I guess someone had to be the “Devil’s Advocate” and support the abnormal, misleading thinking of David Capeless.

Also, it should be a “no brainer” that Martha Coakley (Attorney General) will now petition the United States Supreme Court. Let’s hope the U.S. Supreme Court doesn’t even entertain their petition. Otherwise, it could get very ugly, because you never know how those judges are going to rule. They seem to be very inconsistent lately, and they are sticking together as a party. This means the Democrats are siding with Democrats and the Republicans are siding with Republicans. Regardless of what happens, I will say this: my journey of late has been exhausting emotionally, mentally, and physically. I’m ready for this to be over with and to start my life again. This whole experience has been quite an education, and I plan on sharing what I’ve learned so that it might help someone else.

For now, I must try and stay positive, and who knows – maybe Martha Coakley won’t petition the U.S. Supreme Court. Yeah, I know wishful thinking, but you never know – miracles do happen.

Speaking of miracles, wasn’t that an awesome feeling watching the true happiness of the two American journalists, Laura Ling and Euna Lee being reunited with their families after being held prisoners in North Korea. I have to admit, I had tears of joy in my eyes when I saw Euna Lee embrace her four year old daughter. Dr. Wayne Dyer says that the person who observes an act of true kindness and love can actually feel more from the experience than the ones who are partaking in the event. Supposedly, it has to do with a chemical that is released in the brain. To me, it almost seems impossible, but I guess on some level, it’s very possible – especially when we witness events with our own children’s happiness. Isn’t it weird how young children just trigger something in us that we want to see them be happy. It must be their natural purity and innocence that our inner self or spirit sees. Then it connects or brings our subconscious mind back to a place where we relate to true happiness and love. Okay, I know I’m rambling on, but I guarantee you will remember what I’m saying the next time you see a commercial with children or you have the luxury of witnessing it first hand with your own children. There really is no explanation for why children are so awesome – they are just precious!

Speaking of children, I miss my daughters like crazy. I was hoping I would be out before I lose my parental rights, but it looks like that’s not going to happen especially if the Attorney General goes to the U.S. Supreme Court. That will tie up another six months. Oh well, I just hope they know I love them and miss them very much.

Before I forget, I want to thank EVERYONE for your continued support and positive energy. I have received so many letters telling me that: “you will be free, just hang in there”. You have no idea how much all that inspiration helps. I want to send a special thanks out to my new friends, Douglas and Joanne. You guys have no idea how grateful I am for you coming into my life – both spiritually and inspirationally. Yes, I definitely have been blessed with everyone’s love and support – Thank You!

Last but not least, I want to wish Dick Blanchard a wonderful and Happy Birthday this month. I’m not sure if everyone knows, but Dick’s dedication and loyalty to my cause has been unparalleled. He works extremely hard on the website and keeps everyone updated and informed on all fronts concerning my case and life. Like I have said before - he is a true angel in disguise. I am so grateful he is in my life – Happy Birthday – Dick!

My movie recommendation is: “Knowing” with Nicholas Cage. It is basically a sci-fi thriller, but it is action packed with an unusual story line and ending. I enjoyed it very much, and I think many of you will like it too.

My profound statement is: “Vivere Senza Rimpianti” which means “To Live Without Regrets”.

En Banc hearing denied

Hi Everyone,

I have wonderful news. The US First Circuit Court of Appeals has denied the Commonwealth of Massachusetts appeal for an En Banc hearing. This means that the decision by the 3-judge panel that reversed Michael's conviction on June 11, 2009 remains intact. The only option left for the Commonwealth is for the Attorney Generals office to file a petition for writ of cert to the US Supreme Court, and we believe they will. We expect the Commonwealth will move to stay the order (keeping Michael in prison) while the writ of cert to the US Supreme Court is pending. Michael's lawyer will file a motion for release and try to obtain bail for Michael so he can be released from prison. There is no guarantee this motion for bail will be granted but we are hopeful. I will keep you posted as further events occur.

I want to thank each and every one of you for your prayers and support; they certainly have helped, and Michael remains forever grateful to all of you.
